TERMS OF USE

1. Purpose

Vittascience is a set of online services (hereinafter: the « Services ») allowing the execution, creation, modification and publication of computer programs as well as resources, activities and educational pathways (hereinafter collectively referred to as the « Content »).
Vittascience also offers electronic equipment and didactic kits for sale through the Site; please refer to the General Terms of Sale for further details.

The company VITTASCIENCE (hereinafter: « VITTASCIENCE ») provides, through its website www.vittascience.com (hereinafter: the « Site »), Services intended for teachers and individuals (hereinafter: the « Users ») dedicated to science and digital education.

The purpose of these general terms is to define the terms and conditions of use of the Services offered on the Site, as well as the rights and obligations of Users in this context. They are accessible and printable at any time.

The Site and Services are operated by the company VITTASCIENCE; more details and contact information are available in the Legal Notice.

2. Acceptance of the terms

Acceptance of these general terms by Users is evidenced by an electronic signature during the registration process.

This acceptance can only be full and complete. Any conditional acceptance shall be deemed null and void. Users who do not agree to be bound by these terms must not use the Services.

The Services are accessible to internet users registered on the Site, although part of the Site is available to non-registered visitors for demonstration purposes (see next section for details). If this is your case, please read these terms carefully before browsing the Site or using the Content, as they constitute the legal framework for using the Services. In this context, simply using the Site constitutes acceptance of these terms of use. If you do not agree with each of the provisions of these terms, do not use the Site.

3. Access to Services

It is possible to consult part of the Site free of charge without registration. This browsing mode allows you to test the proper functioning of the Services and Content on your devices and discover Vittascience’s educational model.
This browsing mode does not authorize you to use the Services in class or in public.
Furthermore, several editing features are reserved for registered Users.

Creating an account with secure access (hereinafter: the « Account ») is free, via a registration form available on the Site. Registered Users are authorized to project the Services in class or to the public, and have access to several editing features such as creating resources, activities, or pathways and saving projects in the Cloud.

The Services are accessible to any individual with full legal capacity to enter into agreements under these terms. An individual without full legal capacity may only access the Services with the consent of their legal representative, or in the case of students under the supervision of an adult within their educational institution (teacher, headmaster, counselor, or in exceptional cases a student of legal age).

Users may invite students (hereinafter: the « Learners ») to form groups or virtual classes, simplifying collaboration, especially in a distance-learning context. In such cases, the User is responsible for Learners’ access to the Services, either by invitation code or by manually adding them.

Access to the Services is also possible via the Resource Access Manager (hereinafter: « GAR »), managed by the French Ministry of Education. In this case, the Services will be accessible through the Digital Work Environment (hereinafter: « ENT ») provided to the User by their affiliated school. This access will be compliant with the Technical, Functional and Security Reference Framework (RTFS) of the GAR.

4. Strictly personal use

Only one Account may be created per person. VITTASCIENCE reserves the right to delete any additional accounts created by the same person.

The User therefore agrees to use the Services personally, and not to allow any third party to use them on their behalf.

The User is also responsible for maintaining the confidentiality of their password and expressly acknowledges that any use of the Services from their Account will be deemed to have been carried out by them.

The User must immediately contact VITTASCIENCE at the details mentioned in article 1 if they notice that their Account has been used without their knowledge. The User acknowledges that VITTASCIENCE has the right to take any appropriate measures in such cases.

5. Users’ responsibility

Publishing Content as well as reactions to Content (hereinafter: the « Comments ») must comply with certain rules established by law. We provide here a general overview.

In particular, it is prohibited to insert in Content or Comments:

  • abusive or defamatory material;
  • racist, antisemitic, homophobic, sexist, or ableist material;
  • material inciting hatred, violence, discrimination, or crime;
  • pornographic content or nudity;
  • content promoting alcohol or drug consumption;
  • content imitating a brand or work protected by copyright, except where reproduction and/or representation of such works is permitted under the exceptions provided by article L.122-5 of the French Intellectual Property Code.
Content may consist of text, code, images, or video, this list being non-exhaustive.

VITTASCIENCE reserves the right to unilaterally delete any Content or Comment that does not comply with the above rules or at the request of competent authorities.

Content is created and distributed under the responsibility, primarily, of the User. A User who invites Learners to collaborate becomes the publisher and assumes responsibility for their publications as well as those of their Learners. This must necessarily be an adult (teacher, headmaster, counselor, trainer, facilitator, etc.).

Learners may also be held liable, both civilly (*) and criminally (**), in case of violation of a legal or regulatory rule such as those mentioned above.

In case of doubt, or for specific questions, we invite you to contact the person responsible within your institution (teacher, headmaster, counselor, etc.).

In summary:
  • if you are a User, you are primarily responsible for the Content you publish and, where applicable, the Content published by the learners you invited;
  • if you are a Learner over 18 (adult), your personal responsibility (civil and criminal) may also be engaged in addition to that of the User who invited you;
  • if you are a Learner under 18 (minor), depending on the case, you may be personally liable as the author when legally considered emancipated, or otherwise your legal representatives (generally your parents) will be responsible.
(*) Civil liability refers (in particular) to the obligation to compensate individuals who suffered harm due to content included in a program, resource, or activity (for example, abusive content).

(**) Criminal liability refers to fines and prison sentences that may be imposed by a criminal judge at the request of the public prosecutor.

6. Personal data protection

VITTASCIENCE places great importance on respecting privacy. We invite you to consult our personal data processing policy.

If the User chooses to subscribe and use the Services via the GAR, the data required to create their User Account and their Learners’ Accounts will be obtained by VITTASCIENCE through the GAR.

By mutual agreement, VITTASCIENCE and the User acknowledge their status as joint controllers of these data processing activities concerning Learners, within the meaning of article 26 of the GDPR. This status reflects the respective responsibilities of the User and VITTASCIENCE towards the Learners and their legitimate expectations, in accordance with the guidelines of the competent authorities.

For proper implementation of GDPR principles and obligations, VITTASCIENCE will inform Learners about the processing of their data via a document entitled “Privacy Policy”, available on the Services interface accessed by Learners.

VITTASCIENCE will also handle, in cooperation with the User, Learners’ requests to exercise their rights under articles 15 to 22 of the GDPR.

7. Intellectual property

The Site and all its elements, including but not limited to the Vittascience brand, logos, icons, infographics, and photographs, are protected under international intellectual property law. Unless otherwise stated, these elements are the exclusive property of VITTASCIENCE. Any use, reproduction, or representation, by any means or on any medium, of all or part of the Site and/or its elements is not authorized without the express consent of VITTASCIENCE.

Certain Content available on the Site is published under Creative Commons licenses, including some programs, resources, activities, and pathways. The license used is always indicated on the Content. Depending on the case, it may be:

  • Creative Commons Attribution - NonCommercial - ShareAlike 4.0 International (CC BY-NC-SA 4.0): this license authorizes sharing and adapting the content, provided it is attributed, non-commercial, and shared under the same conditions. More details are available here;
  • Creative Commons Attribution - NonCommercial - NoDerivatives 4.0 International (CC BY-NC-ND 4.0): this license authorizes sharing the content, provided it is attributed, non-commercial, and unmodified. More details are available here.
Any use of the Site’s content contrary to these terms will engage the civil and criminal liability of the User towards VITTASCIENCE.

8. Hyperlinks

The Site provides hyperlinks to websites published and/or managed by third parties.

As no control is exercised over these external resources, the User acknowledges that VITTASCIENCE assumes no responsibility for the availability of such resources, nor can it be held liable for their content.

9. Responsibility of Vittascience

VITTASCIENCE is responsible for keeping the Services online and the server hosting its Site accessible, subject to occasional interruptions for maintenance.

VITTASCIENCE strives, to the best of its ability, to ensure the accuracy and updating of information on the Site, and reserves the right to correct its content at any time and without notice. However, VITTASCIENCE cannot guarantee the accuracy of information provided on the Site.

Consequently, VITTASCIENCE disclaims all liability:

  • for any interruption of the Site, occurrence of bugs, or other events making the Site unsuitable for use;
  • for any inaccuracies or omissions concerning the information available on the Site;
  • and more generally, for any direct or indirect damage, regardless of its cause or nature, resulting from consultation or use of the Site.
VITTASCIENCE’s liability cannot be engaged in cases of force majeure or events beyond its control.

10. Availability of Services

The web format of the Services allows them to operate on most web browsers. The User must have a device (computer, tablet, or smartphone) equipped with a modern web browser and an internet connection.
The Services are designed to work with a minimum screen width of 320 pixels.

VITTASCIENCE cannot guarantee compatibility of its Site with all current or future devices; Users are invited to verify that the Services fully meet their needs.

11. Changes to the Terms of Use

These terms of use may be modified to reflect any evolution of the Services. Such modifications may occur at any time and without notice. Users are therefore invited to consult these terms regularly.

In case of modification of these terms, Users with an Account will receive an alert by email.

The date of the last modification of these terms of use is indicated at the bottom of this page.

12. Applicable law

These terms are governed by French law.

In case of a dispute arising from the use of the Services, we invite you first to contact VITTASCIENCE so that we may discuss the issue and try to resolve it in the best possible way together.

If no amicable agreement is reached, any dispute concerning the interpretation, validity, and/or execution of these terms shall fall under the exclusive jurisdiction of the Paris Judicial Court.
