TERMS OF USE

1. Purpose

Vittascience is a set of online services (hereinafter the "Services") enabling users to execute, create, edit and publish computer programs as well as educational resources, activities and learning paths (hereinafter jointly referred to as the "Content").

Vittascience also offers electronic equipment and educational kits for sale via the Site. Please refer to the General Terms and Conditions of Sale for more details.

The company VITTASCIENCE (hereinafter: "VITTASCIENCE") provides, through its website www.vittascience.com (hereinafter: the "Site"), Services intended for teachers and individuals (hereinafter: the "Users") dedicated to the teaching and learning of science and digital technologies.

The purpose of these terms and conditions is to define the terms and conditions of use of the Services offered on the Site, as well as the rights and obligations of Users in this context. They are accessible and printable at any time.

The Site and the Services are operated by the company VITTASCIENCE. More details and contact information are available in the Legal Notice.

2. Acceptance of the Terms of Use

By electronically signing during the registration process, Users formally accept these terms and conditions.

This acceptance is full and unconditional. Any acceptance subject to reservation shall be considered null and void. Users who do not accept these terms must not use the Services.

The Services are accessible to registered Users. However, part of the Site is made available to non-authenticated visitors for demonstration purposes (see next section for details). If this applies to you, please read these terms carefully before browsing the Site or using the Content, as they define the legal framework of the Services. Using the Site implies acceptance of these Terms of Use. If you do not agree with each condition, please refrain from using the Site.

3. Access to the Services

A portion of the Site may be accessed free of charge without registration. This allows you to test the proper functioning of the Services and Content on your devices and to explore Vittascience's pedagogical approach.

This browsing mode does not authorize the use of the Services in classrooms or in public.

Certain editing features are reserved for registered Users.

Creating a secure account (hereinafter the "Account") is free of charge through a registration form available on the Site. Registered Users are authorized to present the Services in class or in front of an audience, and benefit from several editing features such as creating resources, activities or learning paths and saving projects in the Cloud.

The Services are accessible to any individual with full legal capacity to agree to these terms. Individuals without full legal capacity may only access the Services with the consent of their legal representative, or in the case of students under the supervision of an adult at their school or institution (teacher, principal, counselor, or exceptionally a student of legal age).

Users can invite pupils or students (hereinafter the "Learners") to create groups or virtual classrooms, simplifying collaboration notably in remote learning contexts. In this case, the User is responsible for the Learners’ access to the Services, via an invitation code or by manually adding them.

Access to the Services may also be provided through the Resources Access Manager (GAR), managed by the French Ministry of National Education. In this case, the Services become accessible through the digital workspace environment (hereinafter the "ENT") handled by the User’s affiliated school. This access complies with the requirements of the GAR Technical, Functional and Security Reference Framework (RTFS).

4. Strictly Personal Use

Only one Account may be created per person. VITTASCIENCE reserves the right to delete any additional accounts created by the same individual.

Users agree to personally use the Services and not allow any third party to use them in their place.

Users are responsible for maintaining the confidentiality of their password and explicitly acknowledge that any use of the Services through their Account shall be deemed made by themselves.

Users must immediately contact VITTASCIENCE using the contact information provided in Article 1 if they notice unauthorized use of their Account. They acknowledge that VITTASCIENCE may take appropriate measures in such cases.

5. User Responsibility

The Vittascience platform allows Users to generate content using generative AI interfaces, for instance to create text or images. Publishing and generating Content as well as reactions to Content (hereinafter the "Comments") must comply with applicable laws. Below is a general overview of the main rules to follow:

Users are prohibited from including in any Content or Comment:

• insulting or defamatory materials;
• racist, anti-Semitic, homophobic, sexist or discriminatory materials against people with disabilities;
• materials inciting hatred, violence, discrimination or illegal actions;
• pornographic content or nudity;
• materials encouraging alcohol or drug consumption;
• materials infringing trademarks or copyright-protected works, except where permitted under the exceptions provided by Article L. 122-5 of the French Intellectual Property Code.

Content may include text, code, images, videos and more.

VITTASCIENCE reserves the right to remove any Content or Comment breaching the aforementioned rules or upon request by the competent authorities.

Content is created and published under the User’s sole responsibility. Any User inviting Learners becomes the publication director and is therefore responsible for their own publications and those of their Learners. This User must necessarily be of legal age (teacher, principal, counselor, trainer, facilitator, etc.).

Learners may also be held liable, both civilly (*) and criminally (**), if they breach any legal rule such as those described above.

If in doubt, or for specific questions, please contact the responsible person within your institution (teacher, principal, counselor, etc.).

In summary:

• If you are a User, you are primarily responsible for the Content you publish and, where applicable, the Content published by the Learners you have invited;
• If you are a Learner aged 18 or older, your personal liability (both civil and criminal) may also be engaged in addition to the inviting User’s;
• If you are a Learner under 18, your own liability may be engaged as author if you are considered legally emancipated, otherwise that of your legal guardians (usually your parents).

(*) Civil liability refers notably to the obligation to compensate individuals who have suffered harm because of unlawful content (e.g., insulting materials).

(**) Criminal liability concerns fines or imprisonment imposed by a criminal court at the request of the public prosecutor.

6. Personal Data Protection

VITTASCIENCE attaches great importance to privacy and data protection. You are invited to consult our Privacy Policy.

Where Users choose to access and use the Services via the GAR, the data required to create their Account and the Learners’ Accounts will be obtained by VITTASCIENCE through the GAR.

VITTASCIENCE and the User acknowledge their status as joint data controllers regarding Learners’ data, pursuant to Article 26 of the GDPR. This reflects the respective responsibilities of VITTASCIENCE and the User, and the legitimate expectations of Learners, in accordance with the guidance of the competent authorities.

To ensure proper compliance with GDPR obligations, VITTASCIENCE will inform Learners regarding the processing of their data through a "Privacy Notice" displayed directly in the Service interface they access.

VITTASCIENCE will also handle, in collaboration with the User, any request from Learners to exercise their rights pursuant to Articles 15-22 of the GDPR.

7. Intellectual Property

The Site and all its components — including but not limited to the Vittascience trademark, logos, icons, infographics and photographs — are protected under international intellectual property law. Unless otherwise stated, these elements are the exclusive property of VITTASCIENCE. Any use, reproduction, or representation, by any means and on any medium, of all or part of the Site or its components is not permitted without the express consent of VITTASCIENCE.

Some Content available on the Site is published under Creative Commons licenses, particularly certain programs, resources, activities and learning paths. The applicable license is always indicated alongside the Content. Depending on the case, this may include:

• Creative Commons Attribution - NonCommercial - ShareAlike 4.0 International (CC BY-NC-SA 4.0): permits sharing and adapting the content, provided attribution is given, the use is non-commercial, and derivatives are shared under the same license. More details are available here;
• Creative Commons Attribution - NonCommercial - NoDerivatives 4.0 International (CC BY-NC-ND 4.0): permits sharing the content unchanged, under attribution and non-commercial terms. More details are available here.

AI-generated content

Tools allowing automatic generation of content (texts, images, sounds, code, etc.) based on artificial intelligence models may be made available on the Vittascience platform.

Unless otherwise stated, AI-generated content is made available under the Creative Commons Attribution - NonCommercial - ShareAlike 4.0 International (CC BY-NC-SA 4.0) license.

The User retains the intellectual property rights to the prompts (instructions) they submit to generate content, while acknowledging that the generated output may be similar or identical to results obtained by other Users. VITTASCIENCE reserves the right to display such generated content on the Site or in its communications, in accordance with the aforementioned license.

The User is solely responsible for content generated through these tools, particularly in cases of infringement of third-party rights or distribution of unlawful or inappropriate materials. VITTASCIENCE reserves the right to moderate, delete or refuse publication of any inappropriate or non-compliant content.

Any use of Site content contrary to these terms shall engage the User’s civil and criminal liability toward VITTASCIENCE.

8. Hyperlinks

The Site may contain hyperlinks to external websites operated and/or managed by third parties.

As no control is exercised over these external resources, the User acknowledges that VITTASCIENCE assumes no responsibility for their availability or content.

9. Responsibility of Vittascience

VITTASCIENCE is responsible for maintaining the Services online and ensuring server accessibility, subject to occasional maintenance interruptions.

VITTASCIENCE strives to ensure the accuracy and timely updates of the information displayed on the Site and reserves the right to correct its content at any time without notice. However, VITTASCIENCE cannot guarantee the accuracy of the information provided.

Consequently, VITTASCIENCE disclaims liability:

• for any interruption of the Site, occurrence of bugs or events rendering the Site unusable;
• for inaccuracies or omissions in the information available on the Site;
• and more generally, for any direct or indirect damage resulting from browsing or using the Site.

The responsibility of VITTASCIENCE may not be engaged in cases of force majeure or events beyond its control.

10. Service Availability

The web-based format of the Services enables functionality across most modern browsers. Users must have a device (computer, tablet or smartphone) equipped with a modern web browser and internet access.
The Services are designed for use on screens as small as 320 pixels in width.

VITTASCIENCE cannot guarantee compatibility with all existing or future devices. Users are encouraged to verify that the Services meet their expectations.

11. Amendments to the Terms of Use

These Terms of Use may be amended at any time to reflect improvements or changes to the Services. Users are invited to regularly review these terms.

If modifications are made, registered Users will be notified by e-mail.

The date of last modification of these Terms of Use is indicated at the bottom of this page.

12. Governing Law

These Terms of Use are governed by French law.

In the event of a dispute arising from the use of the Services, Users are encouraged to first contact VITTASCIENCE so that we may discuss and attempt to resolve the matter amicably.

Failing an amicable resolution, any dispute relating to the interpretation, validity or performance of these Terms shall fall under the exclusive jurisdiction of the Paris Judicial Court.
